Wheatland County issued certain Stop Orders and Remedial Orders (the Orders) to GFL Environmental Inc. (GFL) on July 3 and 5, 2019 in connection with the operation of, and nuisance conditions caused by, GFL’s Class I Compost Facility (Facility) situated within Wheatland County.
Following this on July 18, GFL sought to have the Orders stayed (orders would become temporarily halted) and further applied for Judicial Review in an effort circumvent legitimate legislative appeal processes that are available for GFL to challenge the Orders before the Subdivision Development Appeal Board (SDAB) and Wheatland County Council. Following the appearance of legal counsel for both GFL and the County before Madam Justice Ho in the Alberta Court of Queen’s Bench on August 2, the Court in a decision issued on August 9, agreed with Wheatland County Administration and refused to grant the requested Stays or GFL’s application for Judicial Review in the circumstances. As a result, the legislative appeal processes in place to effectively adjudicate any concerns that GFL has with the Orders will proceed. Notices that outline the future times and dates of such processes will be communicated shortly to all residents.
In connection with this matter, Wheatland County also applied to the Court for injunctive relief in an effort to enter on to the GFL Facility site to better understand the environmental conditions on site and to assess the safe removal of the nuisance conditions that are present there which has impacted our residents. As detailed in the Court decision, Wheatland County’s request for relief was denied, which indicates we are unable to enter the premises for inspection. Wheatland County is reviewing the Court’s decision and assessing options going forward.
